• Legal Structure: If the state should implement a HBE, what form
of governance structure (government, quasi-government, non-profit)?
• If public or quasi-public, does the entity need exceptions to regular state personnel, procurement, contracting, open meetings, or open records laws? If non-profit, how do we ensure public oversight and accountability?
• Board composition: What expertise is needed? How do we ensure we get the appropriate expertise? What about potential conflicts of interest?
